UEP Subscription Rewards Program Terms and Conditions
Overview
United Energy Partners, LLC (“UEP”) offers a Subscription Rewards Program to incentivize residential customers to choose renewable energy plans. This policy outlines the terms and conditions of the program, ensuring compliance with Connecticut laws.
Eligibility
The program is available to all UEP residential customers who are enrolled in a 100% renewable energy plan.
- Customers must have an active account in good standing, meaning that the customer has successfully enrolled in a UEP renewable energy plan.
- Eligibility is tiered based on annual kilowatt-hour (kWh) usage:
- Tier 1: 0 to 3000 kWh annually, with monthly benefits of $10 and annual benefits of $120.
- Tier 2: 3001 to 5000 kWh annually, with monthly benefits of $20 and annual benefits of $240.
- Tier 3: 5001 to 8000 kWh annually, with monthly benefits of $30 and annual benefits of $360.
Rewards
- Eligible customers can earn monthly rewards based on their tier, which can be used for gym memberships, streaming subscriptions, or gaming subscriptions.
- Rewards are not redeemable in cash and cannot be applied directly to the customer’s electricity bill or generation bill with UEP.
- UEP does not enroll customers in any incentive programs; customers must handle enrollment independently.
Program Enrollment and Participation
- To participate in the Subscription Rewards Program, customers must enroll in a UEP renewable energy plan through the UEP website.
- Customers must provide accurate and current information during enrollment.
- UEP will not be responsible for enrolling customers in third-party incentive programs. Customers must manage their subscriptions and report any issues directly to the third-party service providers.
Data Collection and Use
- UEP collects and uses customer data to administer the program in compliance with Connecticut data protection laws (Elenianna) (WebsitePolicies).
- By participating, customers consent to UEP sharing necessary information with third parties involved in the program.
Termination and Modification
- UEP reserves the right to modify or terminate the Subscription Rewards Program at any time without prior notice.
- Any changes to the program will be communicated through the UEP website. It is the customer’s responsibility to review the terms periodically.
- UEP may terminate a customer’s participation in the program if they fail to comply with the terms and conditions or engage in fraudulent activity.
Amendments
- UEP reserves the right to amend these Terms and Conditions at any time. Amendments will be effective immediately upon posting the updated terms on the UEP website. Continued participation in the program constitutes acceptance of the revised terms.
Dispute Resolution
- Any disputes arising from the Subscription Rewards Program will be governed by the laws of the State of Connecticut.
- Customers agree to resolve disputes through arbitration in Hartford, Connecticut. Arbitration will be conducted in accordance with the rules of the Judicial Arbitration and Mediation Services, Inc. (JAMS) (Opinion Rewards Panel).
Limitation of Liability
- UEP is not liable for any direct, indirect, incidental, or consequential damages resulting from participation in the Subscription Rewards Program.
- UEP does not guarantee the availability or quality of third-party incentive services and will not be held responsible for any issues arising from third-party service providers (Speedy Stop) (Chevrolet).
Warranty Disclaimers
- The Subscription Rewards Program is provided on an “as is” and “as available” basis. UEP disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Customer Responsibilities
- Customers are responsible for ensuring their eligibility and maintaining good standing with UEP.
- Customers must notify UEP of any changes to their account information or subscription details promptly.
Confidentiality
- Customers agree to maintain confidentiality of all information received from UEP and not disclose it except as necessary for participation in the program.
Trademarks
- Participation in the Subscription Rewards Program does not entitle customers to use any trademarks, copyrighted materials, patents, names, logos, or other intellectual property owned or licensed by UEP.
- Customers may not use UEP trademarks in any advertising or promotional material without prior written consent from UEP.
Indemnification
- By participating in the Subscription Rewards Program, customers agree to indemnify and hold UEP, its affiliates, officers, directors, and employees harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to their participation in the program (Speedy Stop).
Acceptance and Jurisdiction
- By participating in the program, customers agree that they have read, understand, and will abide by these terms and conditions.
- These terms and conditions shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. The federal and state courts located in Connecticut shall have exclusive jurisdiction over any disputes arising under these terms and conditions (CT.gov) (Connecticut Judicial Branch).
General
- Customers may not assign their rights or obligations under these terms to any other party without UEP’s prior written consent.
- UEP may assign these terms and conditions or delegate its rights and responsibilities to third parties without notice to the customers.
- No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
- If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
